DESCRIPTION

Data from the Criminal Courts collection provides nationally comparable statistics about defendants finalised in the criminal jurisdictions of the Higher (Supreme and Intermediate), Magistrates' and Children's Courts across Australia. It includes demographic information about defendants (age, sex, Indigenous status), outcomes (method of finalisation), offences and sentences (for defendants proven guilty).

Experimental data about defendants finalised for selected family and domestic violence (FDV) offences are available for each state and territory, with the exception of South Australia, from 2015-16 onwards. Readers should note that FDV statistics presented in the Criminal Courts, Australia publication are based on experimental data, and further work is required to improve the quality of this data.

COLLECTION METHODOLOGY

Statistics are compiled using administrative by-product data supplied to the ABS by state and territory agencies responsible for criminal courts administration.

SCOPE AND COVERAGE

Persons aged 10 years and over (and organisations) whose case(s) have been finalised within the criminal jurisdiction of the Higher, Magistrates' and Children's Courts during the specified reference period (1 July - 30 June each year).

DEFINITION OF FAMILY AND DOMESTIC VIOLENCE

The experimental data are based on an FDV indicator, which is assigned to a defendant where:
  • Police determined a matter to be FDV related and recorded an FDV flag on their systems which transferred through to the criminal courts administrative systems;
  • The related legislation indicated that the offence(s) were FDV; and/or
  • The court listing indicates that the hearing type was FDV related.

The FDV offences presented are limited to the following offence categories from the Australian and New Zealand Standard Offence Classification (ANZSOC) (cat. no. 1234.0):
  • Homicide and related offences;
  • Acts intended to cause injury;
  • Sexual assault and related offences;
  • Other dangerous or negligent acts endangering persons;
  • Abduction, harassment and other offences against the person;
  • Property damage; and
  • Breach of violence orders.

DEFINITION OF SEXUAL VIOLENCE

Offences relating to sexual violence are defined as described above for family and domestic violence (i.e. via police determination, legislation, or court listing). These offences are coded to Division 3 (Sexual assault and related offences) in ANZSOC, and are defined as 'acts, or intent of acts, of a sexual nature against another person which are non-consensual or where consent is proscribed.'

DATA AVAILABILITY AND DISSEMINATION

The annual publication Criminal Courts, Australia can be accessed via the ABS website and data tables downloaded free of charge. Special data requests are available on a fee-for-service basis through the ABS' National Information and Referral Service.
